Former acting director of Immigration and Customs Enforcement (ICE), Tom Homan, asserted on Sunday that the Trump administration intends to comply with legal directives, despite ongoing litigation surrounding its application of the Alien Enemies Act for deporting undocumented migrants. This development follows a federal judge’s scrutiny of whether the administration violated court orders related to deportation flights.

Judicial Oversight of Deportation Flights

Judge James Boasberg of Washington, D.C., is currently analyzing allegations that the Trump administration proceeded with deportation flights under the Alien Enemies Act, specifically involving Venezuelan detainees, despite a court order to suspend such actions. Homan claimed that the individuals deported to El Salvador were predominantly gang affiliates, suggesting that many were part of Tren de Aragua, which the administration has classified as a terrorist organization.

“That plane removed 240 terrorists from the United States,” Homan stated during an interview on ABC’s “This Week.”

Nevertheless, families of those deported refuted claims of gang affiliations, prompting questions about the basis for the administration’s assertions. Homan refrained from discussing specific cases when pressed for more detailed evidence to support his assertions.

Administration’s Stance on Judicial Authority

Despite Homan’s declarations of adherence to court orders, he expressed a dismissive attitude towards the opinions of judges in the context of this case. He remarked, “I don’t care what the judges think as far as this case,” illustrating a complex relationship between executive enforcement and judicial oversight.

Criticism of Individual Deportation Cases

In the case of Jerce Reyes Barrios, for instance, his lawyer claims he was deported due to a harmless tattoo without any gang affiliations or criminal background. When asked whether the administration would be transparent about these deportation specifics, Homan reiterated that details would emerge through the ongoing litigation process and emphasized reliance on the professional judgment of law enforcement personnel who ascertain gang membership.

Enhanced Security Measures at the Border

As the situation at the U.S. southern border continues to evolve, Homan reaffirmed the administration’s commitment to safeguarding national security. He noted the deployment of over 10,000 troops and naval assets to bolster border enforcement capabilities, adjusting strategies in response to shifting migrant patterns.

In parting, Homan stated, “We’re going to secure the border and make sure no public safety threats or national security threats cross the border and get away,” as he highlighted the ongoing efforts to manage both land and maritime security.
